Virginia: Employee Expense Reimbursement Requirements

verified against the statute 2026-07-14 3 statute sources

The short answer

Virginia Title 40.1 contains no general rule requiring an ordinary private employer to reimburse employee business expenses. The wage-payment section defines and protects wages but does not create a necessary-expense reimbursement standard. Virginia therefore supplies no general request deadline, payment deadline, or reimbursement-specific remedy.

Virginia has no general reimbursement mandate

The employee-protection chapter of Virginia Title 40.1 contains no general
section requiring an ordinary private employer to repay employee business
expenses. Its pay article instead addresses wages, assignments, and sales of
merchandise to employees.

Va. Code § 40.1-29(A) defines wages as remuneration the employer owes, listing
hourly pay, salaries, overtime, commissions, tips, bonuses, and specified
misclassification damages. It does not create a general necessary-expense rule,
mileage rate, reimbursement request procedure, or expense-payment deadline.

Without a general reimbursement scheme, Virginia also supplies no universal
authorization or primary-benefit test, employee-fault exclusions, receipt form,
policy cap, reimbursement interest rule, or reimbursement-specific damages
formula. A right based on a particular agreement or another law would need its
own legal basis.

What trips people up

Va. Code § 40.1-29(D) separately restricts withholding wages without legal
authority or the employee's written and signed authorization. That wage-
deduction rule does not itself create a general right to reimbursement for an
expense paid outside payroll.

Public-employee travel schedules, workers' compensation expenses, and required
protective-equipment rules also answer narrower questions. They do not create
the general private-sector reimbursement mandate covered by this survey.

Common questions

Does Virginia require mileage reimbursement?

Not under a general Title 40.1 reimbursement statute. The title creates no
statewide private-employer mileage rate or universal mileage-payment duty.

Is there a statewide receipt-submission deadline?

No general deadline or proof format appears because Title 40.1 contains no
general employee business-expense reimbursement scheme.

Can every unreimbursed expense be filed as a Virginia wage claim?

Section 40.1-29 protects remuneration the employer owes and regulates wage
withholding. It does not make every employee-paid business expense a general
reimbursement entitlement; the claim would need a separate legal basis.

This page is general legal information about state-law reimbursement of employee business expenses, not legal advice about a purchase, mileage claim, remote-work arrangement, reimbursement policy, or wage claim. The result can depend on whether the expense was necessary, reasonable, authorized or required, primarily for the employer's benefit, documented on time, and within valid policy limits. Separate federal, state, and local rules govern minimum wages, tax treatment, public-employee travel, workers' compensation, wage deductions, and independent contractors.
