2. DEFINITIONS
For purposes of this Petition, capitalized terms have the meanings set forth below. Terms defined in the singular include the plural and vice-versa.
âCollisionâ means the motor-vehicle accident that occurred on the Incident Date described herein.

3. JURISDICTION & VENUE
3.1âThis Court has subject-matter jurisdiction pursuant to Kan. Stat. Ann. ch. 60 because this action is a civil tort claim seeking damages in excess of the jurisdictional minimum.
3.2âVenue is proper in [COUNTY] County under Kan. Stat. Ann. § 60-604 because (a) Defendant resides in, is found in, or may be served in this county, and/or (b) the Collision occurred within this county.
3.3âPersonal jurisdiction exists because Defendant operated a motor vehicle on public roadways in Kansas, thereby purposefully availing himself/herself of the protections and obligations of Kansas law.

4. FACTUAL ALLEGATIONS
4.1âOn or about the Incident Date, at approximately [TIME], Defendant operated a [YEAR/MAKE/MODEL] motor vehicle traveling [CARDINAL DIRECTION] on [ROADWAY/INTERSECTION] in [CITY], Kansas.
4.2âPlaintiff lawfully operated/occupied a [YEAR/MAKE/MODEL] motor vehicle traveling [CARDINAL DIRECTION] on the same roadway.
4.3âDefendant failed to exercise ordinary care in one or more of the following non-exclusive ways:
âa. Exceeding the posted speed limit;
âb. Failing to yield the right-of-way;
âc. Operating a vehicle while distracted and/or impaired;
âd. Disobeying traffic control devices; and
âe. Failing to maintain proper lookout and control.
4.4âDefendantâs vehicle struck Plaintiffâs vehicle, causing substantial physical injuries and property damage (the âCollisionâ).

5. COMPLIANCE WITH KANSAS NO-FAULT STATUTE
5.1âKansas is a âno-faultâ state. Plaintiff has applied for, and/or exhausted, all available PIP Benefits or otherwise satisfies statutory thresholds permitting this tort action.
5.2âPlaintiffâs medical expenses exceed the statutory threshold and/or Plaintiff sustained a qualifying permanent injury, thereby permitting the pursuit of non-economic damages under Kansas law.

6. CAUSES OF ACTION â NEGLIGENCE
COUNT I â Negligence
6.1âPlaintiff realleges and incorporates paragraphs 1-5 as though fully set forth herein.
Duty
6.2âDefendant owed Plaintiff a duty of reasonable care to operate a motor vehicle in a safe, lawful, and prudent manner.
Breach
6.3âDefendant breached that duty by the acts and omissions identified in ¶ 4.3, each constituting negligence per se or common-law negligence.
Causation
6.4âDefendantâs breach was the direct and proximate cause of the Collision and Plaintiffâs injuries.
Damages
6.5âPlaintiff sustained damages described in Section 7, entitling Plaintiff to recovery.

7. DAMAGES
7.1âPlaintiff seeks damages within the jurisdictional limits of this Court, including but not limited to:
a. Past and future medical expenses;
âb. Past and future lost wages and impairment of earning capacity;
âc. Past and future non-economic damages (pain, suffering, mental anguish, loss of enjoyment of life);
âd. Property damage to Plaintiffâs vehicle and personal property;
âe. Pre- and post-judgment interest as allowed by law; and
âf. Costs of this action and any other relief the Court deems just and equitable.

8. COMPARATIVE FAULT ALLEGATIONS
8.1âPlaintiff denies any comparative negligence. However, pursuant to the Kansas Comparative Fault Act (Kan. Stat. Ann. § 60-258a), the relative fault of all parties and non-parties should be compared; any fault attributable to Plaintiff shall proportionally reduce but not bar recovery.

9. PRAYER FOR RELIEF & JURY DEMAND
WHEREFORE, Plaintiff respectfully requests that judgment be entered in Plaintiffâs favor and against Defendant as follows:
- For general and special damages in such amounts as are determined fair and just;
- For costs, statutory interest, and such further relief as the Court deems appropriate; and
- For a trial by jury on all issues so triable.

10.2âNon-Economic Damage Caps. Plaintiff acknowledges the statutory limitations on non-economic damages (Kan. Stat. Ann. § 60-19a02) but reserves the right to contest the applicability and constitutionality of said caps.
