In your letter of June 27, 1994, you asked us to review the taxability of
repairing a well pump used to provide water to a residence.

The well pump which can be easily removed for repair or replacement is
considered tangible personal property and the total charge is taxable. I have
enclosed a copy of a letter that confirms the policy of taxing the repair of
the residential well pump.

The Comptroller is responsible for administering the Texas Tax Code. Other
state laws do not have to be considered in the Comptroller's administrative
process.
