RENTING OR LEASING FOR RE-RENTAL
Introduction
To help in registering, reporting taxes collected and remitting any unremitted portion of the minimum gross rental receipts tax, the following forms and guidelines have been established.
Motor Vehicle Rental Certificate
When registering a motor vehicle that has been rented or leased for re-rental purposes, the vehicle will be titled in the lessor's name (CORP A), not in the lessees name (dealership). When registering the vehicle, if the lessor has a valid motor vehicle retailer's permit number, a motor vehicle rental certificate can be used to register the vehicle tax free while establishing a minimum gross rental receipts tax the lessor (title owner) is liable for. A copy of this certificate should be retained in the dealership's office until the vehicle is removed from rental. For example, see attachment A.
Exemption Certificate
Rent for a re-rental, under the statue of the Motor Vehicle Sales and Use Tax Law for the State of Texas, is an exempt rental. To document the vehicles you are renting or leasing will be used for re-rental an exemption certificate is required. This certificate must be signed by the exempt person or organization (dealership). The completed exemption should be attached to the rental or lease contract and retained by the title owner (CORP A). This certificate is not to be mailed to the Comptroller's Office. For an illustrated example, see attachment B.
Filing Returns
The Motor Vehicle Rental Tax Return is to be completed and filed with the State Comptroller's Office on a quarterly or monthly basis (calendar quarters) depending on volume and tax. Rental dealers have 30 days following the end of each report period to file their return timely. The return should be completed in its entirety, including the rental vehicle inventory (lines 18 through 21). All vehicles rented or leased for re-rental should be listed in the far right column of the rental vehicle inventory (see attached example C). A dealership removing a vehicle leased or rented for re-rental is not required to file a Supplement to the Motor Vehicle Rental Tax Return (a Supplement is to be completed by the title owner of the vehicle). Verification Certificate
When the dealership is removing a vehicle from rental that has been leased or rented for re-rental, proper documentation must be forwarded to the title owner (CORP A). To verify the amount of gross rental receipts tax collected to offset the minimum amount of tax established upon registration, a Verification Certificate (Section 1) should be completed and forwarded to the title owner. A copy of the Motor Vehicle Rental Certificate should accompany the Verification Certificate. Section I of the Verification Certificate should be completed. For an example, see attachment D.
Examples of CORP A Reporting Requirements
At the close of each calendar quarter and after all dealership have reported any vehicles removed from rental, CORP A will file their quarterly Motor Vehicle Rental Tax Return. A Supplement to the Motor Vehicle Rental Tax Return will list all vehicles that were removed from rental during the report period. For an illustrated example, see attachment E.
