Plain-English summary

Pennsylvania Metallurgical and the Secretary had previously resolved parts of two related dockets through an administrative law judge's consent order. The Secretary later filed a notice withdrawing citation items in the consolidated case. The Commission acknowledged the withdrawal and set aside the portion of the judge's consent order that concerned those withdrawn items. The Commission's short order does not identify the withdrawn items by standard number or state a revised penalty amount. The order is the Commission's final disposition of the case.

Decision snapshot

  • Cited standard(s): The Commission order does not identify the withdrawn standards by number.
  • Outcome: Procedural. The withdrawn citation items and the corresponding portion of the consent order were set aside.
  • Key point: A later Secretary withdrawal removes the affected citation items even when they had previously been incorporated into an administrative consent order.
